To be eligible for this visa, the employer must make certain attestations necessary to get a Labor Condition Application approved by the Department of Labor. Also, with the exception of fashion models, the job must require at least a U.S. Bachelor's-level degree or the equivalent and the proposed foreign national employee must have at least a U.S. Bachelor's degree or the equivalent.
